You are responsible for all tax consequences of any promotional payments, gifts, or awards, and you acknowledge we will report any such payments, gifts, or awards to the appropriate state or federal agencies as required by applicable law. Photo and Testimonial Release and Authorization
You are submitting a photo and/or testimonial to Chevron Federal Credit Union/Spectrum Credit Union to be considered for Chevron Federal Credit Union/Spectrum Credit Union’s future use. For valuable consideration, receipt of which is hereby acknowledged,
you agree as follows:
1. You freely grant Chevron Federal Credit Union/Spectrum Credit Union and its licensees, successors, and assigns (collectively, “CFCU”) the perpetual and irrevocable right to use, publish, sell, and otherwise display your name, voice, image,
likeness, biographical information, testimonial, or any other representation of yourself (collectively, a “Likeness”) for any purpose whatsoever, including commercial and non-commercial uses. This right will be royalty-free and extend
throughout the world, in any medium now known or later invented.
2. You agree that all photographs or other depiction of your Likeness that are made, used or taken by CFCU and/or its agent are owned by CFCU and that it may copyright material containing same; you surrender all claims sole of ownership, income, editorial
control and use of your Likeness regarding same.
3. You waive the right to inspect or approve any use thereof.
4. You represent and warrant that your grant to CFCU such rights to your Likeness does not in any way conflict with any existing commitment on your part.
5. Nothing herein will constitute any obligation of CFCU to make any use of the rights set forth in this Release and Authorization.
6. You forever hold harmless, release, and discharge CFCU from any and all claims, actions and demands arising out of or in connection with the use of your Likeness, including, without limitation, any and all claims for invasion of privacy and libel.
7. If any person in the submitted photograph is not yet 18 years old, you hereby warrant that you are a (i) parent; (ii) guardian; or (iii) other caregiver that has received prior written authorization from a parent or guardian, to be made available to
CFCU promptly upon request, of the minor(s), and have full authority to agree to this Release and Authorization on their behalf and hereby exercise that authority.
8. If you submit a photo that includes any person(s) other than you, you certify and warrant that: (i) you have the authority to submit the photo; (ii) you have the full authority to agree to this Release and Authorization on the other person(s) behalf;
(iii) CFCU will have the same rights and protections as it would have if the other person(s) submitted the photo and agreed to this Release and Authorization; and (iv) you agree to indemnify and hold CFCU harmless from any and all claims, actions
and demands out of or in connection with the use of the photo you submitted, including, without limitation, any and all claims for invasion of privacy and libel.
9. You release and agree to indemnify CFCU from and against any and all liability arising out of the exercise of the rights granted by this Release and Authorization.
You agree to all of the provisions of this Release and Authorization (to the extent applicable) by any and all of the following means:
• Submitting a photo or testimonial to be considered for CFCU’s use.
• Physically signing or electronically consenting to this Release and Authorization.
Your electronic consent or submission of a photo or testimonial has the same effect as if you had signed this Release and Authorization with your physical signature. Your physical signature, electronic consent, or submission of a photo or testimonial is also your acknowledgment that you have received a copy of this Release and Authorization in paper form, or if you have provided electronic consent, in electronic form.
